Pedestrian Hospitalized After Hit and Run in Merced

A hit and run accident in Merced left a pedestrian hospitalized on the night of Saturday, July 18, 2020. The pedestrian accident occurred at the intersection of West 18th Street and R Street. A driver of a small black sedan allegedly crashed into a pedestrian who was walking in the area. The driver of the vehicle reportedly fled the scene, according to a news release by the Merced Police Department (Merced PD). The pedestrian was transported to an area hospital for treatment of moderate to serious injuries. An update by Merced PD stated that the injured pedestrian was listed in stable condition. The driver of the hit and run vehicle was last reported to be at large by officials.

Recourse for Recovery of Damages in a Hit and Run Accident Case

When a pedestrian has been struck by a motor vehicle, the injuries and damages are often severe. In the case of a hit and run, the injured pedestrian may be under the impression that they are at a loss in their situation. However, there may be recourse available. If the pedestrian had a car insurance policy at the time of the accident and carried uninsured/underinsured motorist coverage (UM/UIM), a UM claim may help cover medical expenses, lost wages, and pain and suffering caused by the hit and run. If the driver responsible for the injury incident is found but has state minimum bodily injury liability coverage, the pedestrian may bring a UIM claim to supplement any damages not fully covered by the at-fault party. If the pedestrian did not have car insurance at the time of the accident but lived with a relative who did, a UM or UIM claim may be brought against that family member’s policy so long as they were not listed as an excluded member of the insurance plan. What is the Filing Deadline for a Personal Injury Claim in California?

In California, a person has two years after their pedestrian accident to bring a personal injury lawsuit. This is by the California Code of Civil Procedure Section 335.1. Time is of the essence in such cases as memories can fade, and evidence may be destroyed or lost. Without these, it can be challenging to prove your personal injury case as time goes by. Insurance companies may dispute the validity or value of a personal injury claim that does not have the evidence to support it, making it challenging to reach a fair settlement. When a personal injury case is not resolved within two years, a lawsuit must be filed to protect it from being dismissed by the court, and the right to financial recovery from being lost. Do not delay retaining a Merced injury attorney early in the personal injury claims process so you can submit your case on time.
