Types of Wrongful Death Compensation

Wrongful death liability in a fatal pedestrian accident case is expressed in financial compensation. The goal of a wrongful death claim is to seek compensatory damages for the harm which survivors have suffered because of their loved one’s death. Economic and non-economic damages in a wrongful death case may include medical expenses, funeral costs, mental anguish, lost future financial support, and loss of care, guidance, and companionship. At our law firm, our Modesto wrongful death attorneys can review the losses in your case to calculate these losses. Our legal team can also consult with expert witnesses who can help us assess the financial support your loved one would have contributed to the household for the remainder of their life. In some wrongful death cases, punitive damages may be sought as well to punish the at-fault party and prevent similar behavior from them and others in the future. What is the Statute of Limitations for a Wrongful Death Case in California?

In California, a wrongful death claim must be filed before the statute of limitations or the legal time limit expires. To comply with the wrongful death statute of limitations in California, a lawsuit must be filed with the court within two years of the date of a loved one’s death. In some circumstances, there may only be six months or 180 days to file for wrongful death if the loss was the result of government entity negligence. For this reason, it is best to reach out to an experienced and best-rated personal injury lawyer in Modesto to review your wrongful death pedestrian accident case involving a government vehicle and ensure all filing deadlines are met in your case.
