What Survivors Should Know About Wrongful Death Cases for Pedestrian Accidents

Pedestrians involved in motor vehicle collisions may suffer severe and debilitating injuries. In some cases, they may succumb to accident-related injuries. Those who have been injured or lost a family member in a car versus pedestrian accident may have grounds for a claim for damages. In wrongful death matters, compensation may be awarded to eligible surviving family members. Those with priority generally include the domestic partner, spouse, or children. Other relatives may have eligibility based on the facts and circumstances surrounding the matter.

While no amount of financial recovery may undo the loss or reverse the harm survivors have experienced, it may assist them in moving forward without having to worry about their financial stability in the future. The first step in recovering compensation in a wrongful death pedestrian accident case is to retain legal counsel. Remember that these cases are subject to a two-year statute of limitations but may be shortened to six months if the matter involves a public agency. An experienced attorney can help your family navigate California wrongful death law and claims process with insurance companies.

As a survivor, you may seek compensation for the loss of a loved one and the associated damages through a wrongful death action. If the at-fault party does not have auto insurance, or they have insufficient coverage, you may have other options for recovery. This includes your family member’s insurance policy or your plan if there is uninsured and underinsured motorist coverage available. To bring a UM or UIM claim under your plan, the deceased must have been a member of your household and not excluded from the policy.
