How Can a Wrongful Death Claim Help Survivors?

If a vehicle versus pedestrian crash caused fatal injuries to an individual, the family of the deceased may seek financial compensation for their losses. This is possible through a wrongful death claim. Such cases are generally filed against a negligent party and their insurance carrier. These allow survivors to seek reimbursement for non-economic and economic damages incurred because of a close relative’s unexpected passing in a pedestrian accident.

There is a deadline for wrongful death cases in California. This is referred to as the statute of limitations. The time limit starts on the date of the fatal incident. Per CCP 335.1, eligible survivors have up to two years to file, with few exceptions. For instance, if a fatal accident case involves a public agency, a notice of claim must be filed with that entity no later than six months from the accident date. For reasons like these, it is crucial to have legal counsel that will handle a case from start to finish on behalf of survivors.
