Recoverable Damages in Pedestrian Accident Cases

An individual on foot who is hit by a motor vehicle often requires emergency medical care, surgery, and extensive treatment for months or even a lifetime. Aside from the past and future costs of treatment, other losses may occur as a result of the incident. This may include wage loss, diminished earnings, out-of-pocket expenses to renovate a home or vehicle to accommodate permanent injury or disability, and more. Conversely, intangible harm may include loss of quality of life, pain and suffering, and loss of consortium. These may be sought in a claim for damages against the at-fault party.

In situations where injuries from the pedestrian accident prove fatal, surviving family members may file a wrongful death action to seek reimbursement for economic and non-economic damages. These may include loss of companionship, affection, and love, mental anguish, medical costs for final injuries (via survival action), funeral and burial bills, and other relevant losses. In either scenario, there may be concerns regarding insurance. Claimants may resort to their uninsured and underinsured motorist protection if the other side has limited to no liability coverage.

Insurers often resort to various defense strategies to limit the amount they pay in settlements for personal injury and wrongful death claims. Who Can Be Held Liable for a Car Versus Pedestrian Collision?

Various parties may be held liable for resulting losses when a pedestrian is injured or killed in a traffic accident, including:

  • Driver: In most cases of pedestrian accidents, the motorist that caused the crash is usually liable if they failed to yield the right of way to the individual, was driving under the influence, or engaged in other negligent conduct causing harm to others.
  • Government Entity: The public agency in charge of maintaining the roadway may be held liable for damages if a pothole, road signage obscured by overgrown foliage, insufficient street lighting, malfunctioning streetlights, or a poorly designed intersection contributed to a crash.
  • Vehicle Manufacturer: If the collision was caused by faulty car parts and equipment, the manufacturer may be held accountable for the resulting damages. This may be a brake that failed, a new tire that blew out, etc.
