What is a Wrongful Death Claim and How Can it Help Our Family?

Losing a loved one is painful, particularly if it is unexpected. California law defines wrongful death as the loss of life that occurs from the negligent actions of another party. In the context of a pedestrian accident, wrongful death may occur from a driver who was speeding, driving under the influence, and other careless driving habits. While a claim cannot replace the loss, a successful case may allow survivors to seek damages from the party whose negligence contributed to their close relative’s demise.

When a claim is brought forward, surviving family members filing the case may seek reimbursement for economic and non-economic damages. These may include mental anguish, loss of prospective inheritance, funeral service costs, medical bills (this is recoverable via survival action), loss of companionship, loss of financial support, and more.

The value of a wrongful death case varies and depends on several factors. That is why it is best to have a skilled Modesto wrongful death attorney on your side. While no amount of money can undo the pain of losing a close relative or bring them back, it may help pay for unexpected expenses and help surviving family members rebuild their lives. It may also provide a sense of closure, knowing that the party responsible for a loved one’s demise has been held financially accountable for their actions.

How Do You Prove Wrongful Death?

A successful outcome in a wrongful death case depends on the evidence available. There must be clear and compelling evidence that an individual or entity was reckless, careless, or negligent in causing a loss of life. For instance, if a driver engaged in careless conduct that caused a fatal pedestrian crash, this may be deemed wrongful death.
