What Types of Losses are Recoverable in a Pedestrian Accident Case?

If an injured party reaches a mutual settlement agreement with the insurance company or a civil court rules in their favor, they may receive compensation for economic and non-economic damages in connection with the incident. This may include:

  • Costs of medical treatment for injuries associated with a vehicle versus pedestrian collision
  • Wage loss and diminished earning capacity from the temporary or permanent inability to work because of accident-related injuries
  • Physical pain and emotional suffering from injuries suffered in the incident and its effects on the claimant

Should You Accept the First Offer from the Insurer?

While we would expect insurance carriers to have our backs after a life-altering event, such as a pedestrian accident, that does not necessarily happen in all cases. When an insurer is aware that their policyholder is liable for losses, claims adjusters may resort to defense strategies to pay the lowest amount possible. Injured parties should not accept initial settlement offers from insurance carriers until they have discussed their case with a California personal injury attorney.

Early settlement offers tend to be much less than what injured parties deserve for their losses. When an offer is accepted, a claimant signs away their right to seek additional damages. Therefore, those facing such situations may benefit from a free consultation with an experienced injury lawyer in their area. This should be done before discussing the claim with the insurance carrier. Any words in a recorded statement with the insurer may be used against you. Therefore, protect your rights and interests by working with a pedestrian accident lawyer today.
