Things to Know About Car Versus Pedestrian Collision Cases

When a person is hit by a car, even a collision at low speeds may cause serious injury. Common pedestrian injuries include TBIs, broken bones, spinal cord injuries, lacerations, contusions, and more. When motorist error is the root cause of the incident, a pedestrian may seek reimbursement for medical bills, lost earnings, and other damages in a bodily injury claim. These claims are generally brought against the insurer representing the at-fault driver. If the negligent party does not have insurance or has minimal limits, uninsured and underinsured motorist coverage may be an option for recovery.

For liability to be established in a vehicle versus pedestrian collision, an individual or entity must be identified as at fault for the incident. For instance, a driver has a duty to exercise due care to others on the roadway, including individuals on foot. When a motorist breaches that duty and a pedestrian crash occurs, they may bear liability for the incident. There are a number of reasons why a driver may be held liable for a pedestrian accident, including speeding, failure to yield the right-of-way, running red lights or stop signs, distracted driving, and DUI.

When insurers learn of car versus pedestrian accidents, they are often eager to handle bodily injury claims as soon as possible. This often means paying the least amount possible. Injured parties should not be pressured into accepting an insurance settlement that is far less than they deserve. A skilled California personal injury lawyer can advocate for an injured pedestrian’s needs and seek the full compensation to which they are entitled. An attorney will also work to secure justice by holding a negligent motorist accountable for their careless or reckless actions behind the wheel.
