Personal Injury Claims and Pedestrian Accidents

A car vs. pedestrian accident may be devastating, particularly when it is the result of someone else’s negligence. Those who are struck by vehicles while standing near the road or walking often suffer traumatic injuries or even succumb to their injuries. All too often, crashes involving pedestrians are preventable as the at-fault party could have avoided the situation had they exercised due care. When this happens, the pedestrian may seek financial compensation for their injuries and losses incurred. This may include costs of medical treatment for injuries sustained in the pedestrian accident, lost earnings, loss of future earning capacity, pain and suffering, and more.

Since the stakes are often high for personal injury cases arising from car vs. pedestrian accidents, it is essential for injured parties to understand their potential options for recovery. This is especially true in a state like California, which has a high rate of drivers without liability coverage. A 2019 report by the Insurance Information Institute (III) revealed that 16.6 percent of drivers in California were uninsured. In the event that a pedestrian is injured in a crash caused by a driver without auto insurance, they may bring a claim with their insurer if they have uninsured motorist (UM) coverage. This type of protection may come into play up to the limits of the plan. Conversely, the pedestrian may also bring a claim under their underinsured motorist (UIM) protection if it has been determined that the other side’s policy limits are insufficient to cover damages incurred.

It is essential for an injured party to work with an experienced accident attorney who can protect their rights and interests from the insurer’s tactics. That is because insurance companies, including your own, are focused on protecting their profit margins. Unfortunately, this may come at the expense of claimants looking to be compensated for the undue harm they have experienced because of another party’s negligence. Conversely, it is the job of an experienced Merced pedestrian accident lawyer to hold at-fault parties and insurance companies accountable for making injured parties whole again through the form of fair compensation.
