What Families Should Know About Wrongful Death Cases

Coming to terms with the unexpected loss of someone you love is a difficult experience. However, when the loss occurred from an accident caused by another person or entity’s negligence, the grieving process may be compounded with frustration and anger. Surviving family members may wonder how they will manage without their loved one by their side. While time cannot be turned back and the pain cannot be undone, survivors may be able to arrive at an understanding and acceptance through holding the at-fault party financially accountable for the harm they have caused. A skilled Los Banos wrongful death lawyer can provide assistance with this endeavor.

Bringing a wrongful death claim may seem too daunting of a task to fulfill after the unexpected death of a family member. This is especially true in the case of a fatal pedestrian accident involving a large commercial truck. However, with the support of an experienced attorney, surviving family members will have the compassionate guidance necessary in bringing a case that is in their best interest. The types of recoverable damages may include medical and funeral costs, lost income and other earnings, loss of companionship, mental anguish, and other losses.

Determining the full and fair compensation a family rightfully deserves may be challenging, particularly since non-economic damages cannot be assigned definite monetary values. Surviving family members should keep in mind that any initial settlement offer they receive from the insurance company may not fully account for the damages they have endured. However, a skilled lawyer will have the experience and resources necessary to determine all the economic and non-economic damages a family has suffered and advise them on what to expect from their claim. Watch the video below for more details on the wrongful death claims process.

Importance of Working with an Attorney on a Wrongful Death Case

In a wrongful death claim involving a commercial driver, liability may lie with several parties. This may include the operator of the large commercial truck, the trucking company that hired the driver, and more. Since the successful outcome of a case will depend on proving negligence on the part of the other party, a family will need an experienced attorney to establish that through a collection of compelling evidence. Since evidence may be lost or destroyed over time, it is essential to work with an attorney immediately after a fatal crash.

An attorney with years of experience handling truck accident cases will know the best way to proceed, including sending letters of preservation of evidence to the truck driver and the trucking company. A lawyer will work to ensure that those whose actions contributed to the loss of a loved one will be held financially accountable for the damages they have caused. When a family retains an attorney, they can count on their lawyer to protect their rights and best interests for the much-needed compensation to prove for a more secure future.
