How a Wrongful Death Claim May Help Surviving Family Members

Few events in life are more challenging to process and come to terms with than the unexpected loss of a close relative. When a loved one is lost in an unexpected accident that could have been prevented, the experience may have life-changing effects on surviving family members. Wrongful death refers to the loss of life that occurs through the negligence of a third party. When this occurs, the family of the deceased may bring a wrongful death action against the person or entity that is responsible for the loss of life. In a fatal pedestrian accident case, a claim may be brought against the negligent driver and their insurance company for reimbursement of losses incurred. In the case of a hit-and-run, a claim may be brought under the decedent’s auto insurance policy or that of their household member if they have uninsured motorist coverage.

While the death cannot be undone, contacting an experienced accident attorney may simplify the process for survivors. A lawyer can focus on handling legal proceedings while the family shifts their full and undivided attention toward coping with grief. Who Can Bring a Wrongful Death Case in California?

The California Code of Civil Procedure Section 377.60 sets out the category of individuals who have priority to bring a wrongful death claim forward. This includes the spouse, domestic partner, or children of the deceased. Depending on the facts and circumstances of the case, other relatives may be eligible for filing if these relationships are non-existent with the decedent.
