How Can a Wrongful Death Action Help Our Family?

The loss of a family member is challenging regardless of the circumstances involved. The anguish and grief experienced over the sudden loss may be compounded by confusion and anger when it was the result of someone else’s careless or negligent actions. It is essential to consider the rights you may have as a surviving family member to seek justice and compensation for your loss. No amount of money may undo the pain of losing someone you love or replace them in your life. However, a successful wrongful death claim may provide your family with the sense of closure and justice you all deserve.

Compensation in a wrongful death action is expressed in economic and non-economic damages. Economic damages are intended to reimburse quantifiable losses, whereas non-economic damages reflect intangible losses that survivors have suffered because of a close relative’s demise. These may include any medical expenses associated with the decedent’s final injuries (recoverable via survival action), mental anguish, the value of what the deceased would have earned in wages and benefits, any bills related to funeral and burial services, and more.

When you are choosing whether to bring a wrongful death claim, speaking with a skilled accident lawyer may be useful. An attorney will listen to your story, help you become well-aware of what is involved in the legal process, and explain your rights moving forward. When you retain legal counsel, you can count on your attorney to coordinate the investigation into the incident to properly determine fault and build a strong case for full compensation on your behalf. If your family has lost a loved one due to someone else’s reckless or negligent actions, it is essential to contact an attorney to tell your story, learn about your rights, and go over your options for moving forward.
