Understanding Wrongful Death Cases in California

Wrongful death in California is defined as any loss of life that results from the negligence of another person or entity. Understanding California’s wrongful death law can help surviving family members make well-informed choices for filing a claim for damages:

  • Statute of Limitations: California sets a strict deadline on when cases of wrongful death must be filed in civil court. California’s statute of limitations allows claimants two years from the date of loss to file a case. Specific exceptions may apply. Schedule a free consultation with an experienced California wrongful death attorney at AutoAccident.com for specific information regarding your case.
  • Filing Eligibility: In California, not any family member may file a wrongful death action. CCP 377.60 outlines those with priority for filing. These generally include the domestic partner, spouse, or children of the deceased individual. Various factors may affect eligibility for filing. Determine your eligibility by speaking with a skilled accident attorney from our law office today.
  • Damages Available: Damages in a case of wrongful death in California fall into two categories: non-economic and economic damages. Eligible claimants may seek reimbursement for loss of financial support, funeral and burial service costs, medical bills caused by the incident up to the time of death (recoverable via survival action), mental anguish, loss of companionship, and other related losses.

It is understandable that financial recovery is not the most important reason for filing a claim for wrongful death. Surviving family members deserve answers, a sense of closure, and justice for losing a loved one in an accident. That may be accomplished by holding the other side accountable for their actions through a wrongful death claim.
