Wrongful Death Lawsuits in California: Who Can File One?

Wrongful death claims can be brought by the following parties in California:

  • The spouse or domestic partner of the deceased
  • The deceased’s children
  • A deceased’s parents (in the absence of a spouse or children)
  • An executor of the estate of a deceased person

It is possible for others to file a claim for wrongful death if they have proof they were dependents of the deceased at the time of his or her death. The decedent’s stepchildren and parents may be included in this group.

One important point to make is that only one wrongful death claim can be filed. This means either the spouse and immediate family may file a claim or the estate administrator.
