What You Should Know About Personal Injury Claims

Motor vehicle collisions happen every day in Contra Costa County and throughout California. While there is a wide array of reasons why traffic crashes occur, they often lead to the same outcome, with that being a party with traumatic injuries. This may result in mounting medical expenses, time away from work, and other losses. Fortunately, losses resulting from a car accident are recoverable through a personal injury claim filed with the insurer representing the negligent driver. While we would expect all drivers in California to carry liability coverage, that is not always the case. That is because some motorists fail to do so, and when they cause traffic collisions, this may result in stressful challenges for parties injured by their negligence. Fortunately, an injured party may have recourse if they have uninsured motorist coverage. That is because this type of coverage will come into effect up to the limits of the policy. If the at-fault party has liability coverage but carries minimal limits, an injured party may turn to their underinsured motorist coverage to supplement other resulting losses not fully covered.

There are strict filing deadlines involved in a personal injury case. Under the California Code of Civil Procedure Section 335.1, a lawsuit must be filed within two years from the date of the incident if the claim has not yet been resolved with the insurance company through a settlement. Failure to meet this standard may result in the court’s dismissal of the case and the loss of the claimant’s right to seek compensation for their losses arising from the car accident. That is why it is essential for those who have been injured in a traffic crash to seek out the assistance of an experienced injury lawyer immediately after the incident to ensure that their rights and best interests are protected. The reason behind this is that other filing criteria may be involved in these cases, such as those involving government entities. Under these circumstances, the deadline may be shortened to six months. Reach out to the best lawyer in your area to discuss your case in detail in a free consultation.
