One Vehicle Rollover after Accident in Oakley

I’m Ed Smith, an Oakley Personal Injury Lawyer. One car was overturned after a two-vehicle collision in Oakley, California, on Tuesday, October 31st, 2017. Below is a full report of the story.

How Did This Happen?

According to the Oakley Police Department, a van was driving on Rose Avenue heading south when it collided at an intersection with a gray Toyota Prius that was traveling westbound on Laurel Road. The accident was called in at approximately 3:35 p.m. on Tuesday afternoon.

Currently the origin of the incident is unknown, as the accident is still under investigation by Oakley Police. However, police officers do believe that it’s possible one of the cars may have failed to come to a complete stop before entering the intersection on a four-way stop.

One Driver Hospitalized

Upon impact, the Toyota Prius rolled over on its roof. The car came to a stop in the westbound lane of Laurel Road. The Toyota driver was able to remove himself from the vehicle after the accident. An ambulance transferred him to a local hospital after his complaints of severe head pain. On the other hand, the owner of the van involved was determined to have no serious injuries and was released at the scene after talking with Oakley police officers.

Moving forward, police plan to individually interview both drivers involved and witnesses to the incident in order to determine who is at fault in this collision.

Most Accidents Caused by Driver Mistakes

Stanford University released a report stating that at least 90% of accidents are at least partially caused by driver error. The National Highway Traffic Safety Administration (NHTSA) has outlined the various causes of driver error:

  • 41% – distracted driving or inattention, whether it be outside or inside of the vehicle
  • 33% – decision error; this can refer to speeding, misjudging a nearby car’s speed, taking a sharp turn too fast, etc.
  • 11% – performance error; this can be driving mechanisms such as overcorrection, or just poor driving skills
  • 7% – lack of sufficient sleep or falling asleep behind the wheel 
  • 8% – other causes
