California Wrongful Death Claim Filing

In California, wrongful death claims require evidence to support them if the family of a pedestrian has lost a loved one. Anyone who dies as a result of another’s negligence or wrongdoing can be held liable for damages under California law. If a pedestrian is killed during a traffic collision as a result of an at-fault driver’s negligence, his or her family may be entitled to compensation for their loss.

A Wrongful Death Case Requires Evidence Collection

Traffic collision cases can be investigated by an attorney to determine evidence that supports wrongful death claims. Records such as police reports, witnesses’ statements, medical bills, pictures of the accident scene, and other relevant documents should be collected. Expert witnesses can also testify regarding the cause of death and the negligence of the at-fault party.

An experienced California wrongful death lawyer should be contacted as soon as possible after the accident in order to make a successful claim. A lawyer can assist in gathering evidence and evaluating its strength in order to ensure that all aspects of your case are considered. You can also find out what your legal rights are and how to pursue a successful claim from them.

What Can Be Recovered in a California Wrongful Death Lawsuit?

There is a variety of compensation that can be recovered in a wrongful death action under California law, including the following:

  • The expenses associated with funerals and burials can be recouped.
  • It is possible to recover the financial support the deceased provided, including their pension, insurance and other benefits.
  • There may be a claim for loss of guidance, advice, love, protection, and moral support provided by the deceased.
  • The deceased would have provided household services such as cleaning or repairs, which can be recovered.
  • If an at-fault party is found to have acted recklessly or maliciously, punitive damages may be available.

Those who wish to file a wrongful death claim in California have a limited amount of time to do so. The only people who can file a claim for a deceased person are their close relatives, such as their spouses and children. If the deceased had no spouse or children, then parents and siblings may be entitled to file.
