Pedestrian Fatality Accident Wrongful Death Claim

The thought of filing a wrongful death claim may seem too far away when a loved one suddenly passes. However, it is possible to suffer serious financial consequences after losing a loved one, especially if the person was a valuable source of income for the entire family. As well as providing a sense of justice and closure, wrongful death claims can also assist the family financially after losing a loved one. You may be able to recover damages in the following areas in a wrongful death lawsuit:

  • Funeral and burial expenses are recoverable.
  • Until their normal retirement age, the family can claim bonuses and pension benefits in addition to wages. Recovery of damages by a self-employed person may be possible by using tax returns and other proof of income.
  • Depending on the circumstances, beneficiaries in the will of a deceased may be able to recover inheritance losses.
  • A surviving spouse may also claim reimbursement for losing the affection and moral support of their loved one in addition to the loss of consortium.
  • There may be a claim that the children of the deceased, as well as other minors who depended on the deceased for at least half their support, have lost their parental instruction, nurturing and love.
  • It may be possible to recover household assistance lost. A decedent’s duties may include lawn maintenance, childcare, servicing and repairing family vehicles, and others. Because of the death, the family may be required to pay someone to do the work the deceased did, and this can be recovered.
