Loss of a Loved One in a Fatal Accident in Fresno

Losing someone you love in a motorcycle crash can be devastating and heartbreaking. Addressing the legal and financial issues related to the loss can be particularly challenging during the grieving process. If the incident resulted from someone else’s negligence, an experienced attorney can help manage all aspects of the wrongful death case to ensure the family can focus on recovering from their loss and other important manners.

Who Can Bring a Wrongful Death Case in California?

In California, a wrongful death claim may be filed against an individual or entity whose recklessness or negligence resulted in a loss of life. This type of case would have to show that the at-fault party, through their negligent actions, demonstrated a disregard for the safety of the loved one. That behavior was the cause of the wrongful death motorcycle accident. In California, specific surviving family members of the decedent may bring a wrongful death case. Those eligible to claim monetary damages are:

  • Spouse, domestic partner, or children
  • Parents, stepchildren, putative spouse, or children of the putative spouse if there is no child or spouse
  • Minors who were dependent on the decedent for financial support

What Can Be Recovered in a Wrongful Death Claim?

After losing a loved one in a fatal motorcycle accident, finances may be the last thing on a family’s mind when dealing with grief. As survivors look into the future, a wrongful death claim against the at-fault party is what they need to have the financial support and peace of mind, they need to move forward. A family may receive financial compensation for economic and non-economic damages, such as:

  • Any costs a family has had to pay for a lost loved one’s medical treatment after the motorcycle accident that ultimately claimed their life (this may be recovered through a survival action)
  • Loss of a family member’s care, love, and protection
  • Lost future financial support the family has experienced as a result of the wrongful death motorcycle accident
  • The reasonable costs of a loved one’s funeral and burial services
