Details on the Crash in Oakley That Left a Motorcyclist Injured

Officials indicated in a preliminary report that a motorcyclist was riding in the area when they were involved in a collision with another vehicle. Engine 53 with ECCFPD arrived at the scene and found the motorcycle rider down in a yard after crashing into the car. Officials said it may have been possible that the motorcyclist also struck a tree after the initial accident.

The motorcycle accident prompted the closure of the roadway for a period as officials worked to conduct an investigation. The motorcycle rider was taken by ground ambulance to Creekside Park, where he was later transported via air ambulance to an area hospital. No other details about the car vs. motorcycle crash in Oakley have been released by officials.

Things to Know About the Motorcycle Accident Claims Process

Motorcyclists are among the most vulnerable on California roads. Given their lack of physical protection, despite having helmets and protective gear, they may suffer some of the most severe injuries on the spectrum because of this. When drivers of other vehicles fail to spot motorcycle riders on the road or engage in negligent conduct that places them at risk, a catastrophic crash is likely to occur. A motorcyclist injured in a collision through no fault of their own may be entitled to compensation for past and future losses such as medical bills, wage loss, and pain and suffering. This is accomplished through bringing a strong and compelling injury case against the at-fault party and their insurance company. Remember that the claims process is not always straightforward because insurers are looking to pay as little as possible to protect their profit margins.

At the end of the day, insurance carriers are businesses that are focused on maximizing profit margins. Accomplishing that may often involve resorting to unfair biases against motorcycle riders. While we know that bikers are safe and conscientious, the other side will attempt to paint a picture of an irresponsible motorcycle rider that was speeding, weaving in and out of traffic, or engaging in other careless conduct. That is their way of paying as little as possible on a personal injury claim.

Without an Oakley personal injury lawyer by their side, an injured biker may be at a significant disadvantage against an insurance carrier and their teams of claims adjusters and investigators working quickly to reduce the value of claims or outright deny them. That is why it is recommended to retain legal counsel after getting treated for injuries from a car vs. motorcycle crash. An injury lawyer can step in to conduct an independent investigation of the incident, collect evidence to establish negligence on the part of the other side, and work with the insurance company to negotiate a fair settlement on your behalf while you focus on recovering from your injuries. An attorney will also work to ensure that the insurer treats you fairly. When the lawyer handling the case has exhausted all attempts at a fair and reasonable settlement, they will take the case to court for a judge or jury to decide an appropriate award.
