Seeking Justice and Financial Recovery in a Wrongful Death Motorcycle Accident Case

Vehicle versus motorcycle collisions are often the result of driver negligence. This may stem from motorists who fail to exercise the duty of care they owe to others on the roadway, including motorcycle riders. Any behavior or action that violates this duty of care may constitute negligence. When this occurs, an injured biker or surviving family member may bring a personal injury or wrongful death claim against the at-fault party to seek damages.

The purpose of economic damages in a wrongful death action is to decrease the financial hardship that may accompany the fatal incident and the unexpected loss of life. Non-economic damages reflect the intangible harm inflicted on survivors due to the sudden loss of a family member. As with loss of financial support and costs of final resting arrangements, loss of companionship, care, and affection is specific to cases of wrongful death. This refers to the fact that the deceased relative is no longer around to provide guidance, express affection, and support surviving family members.

Driver negligence claims the lives of one too many motorcycle riders every year. No matter how the crash occurred, an experienced California wrongful death attorney can help surviving family members understand their rights and options for financial recovery moving forward. Remember that time is of the essence in accident cases. If a lawsuit is not filed within the two-year statute of limitations, which generally applies in most cases, surviving family members may be unable to seek damages through the civil court system. As such, it is in a survivor’s best interest to contact an attorney immediately.

What Are the Benefits of Hiring an Attorney for a Wrongful Death Case?

Retaining legal counsel for a wrongful death motorcycle accident case may come with various benefits. One of which includes taking over all legal aspects of the case moving forward. This will allow surviving family members the time and energy they need to focus on grieving their loss and rebuilding their lives. Furthermore, a lawyer can provide guidance and support at every point of the legal process all while providing regular case updates as they occur. An attorney can also conduct an in-depth investigation, manage case communications, and negotiate a favorable settlement agreement on your behalf.

It is understandable that surviving family members may feel conflicted about retaining legal counsel or filing a wrongful death case. The wrongful death claims process may be a challenging and drawn-out one, especially when difficult insurance carriers and defense counsel are involved in the matter. Survivors may also express concerns about the costs of legal representation. Fortunately, most attorneys, like ours at AutoAccident.com, work on contingency. This means that a client is not charged legal fees upfront, and they will only be collected if a successful result is obtained. Learn more about our law firm in this video.
