Compensation for a Wrongful Death Motorcycle Accident

The loss of a close relative is one of the most difficult, emotional, and stressful events in life. When that individual’s life is cut short because of another party’s carelessness or negligence, the grieving process that is already overwhelming may be compounded with frustration and grief. While reaching out to an attorney following the loss of a family member may be challenging, taking quick action is necessary to obtain the accountability and justice you and your loved ones deserve. Furthermore, an attorney can handle your case from start to finish and protect your rights every step of the way.

The right attorney will have the experience, resources, and knowledge to effectively manage a case of wrongful death. The purpose of these cases is to seek financial recovery for what was lost due to the fatal incident. A lawyer will do everything in their power to seek maximum compensation on behalf of their client through a settlement or verdict. Economic and non-economic damages typically recovered in these matters include loss of companionship, mental anguish to the decedent’s family, funeral and burial services, loss of financial support, and more.

Understanding Wrongful Death Law in California

As California wrongful death lawyers, it is our duty to ensure that our clients fully understand the specifics of their cases and what to expect from the legal process moving forward. In California, the individuals who have priority for filing cases include the decedent’s children, domestic partner, or spouse, per CCP 377.60. Other relatives may still bring a case, provided that the previously mentioned relatives do not exist. An eligible claimant has two years from the date of loss to file a lawsuit. It is encouraged to act quickly so the right to seek damages is not lost from missing the deadline.

While wrongful death claims are generally resolved through insurance negotiations, there may be cases where a mutual agreement cannot be reached with defense counsel and insurers. In that case, it would be necessary to file the case within the applicable statute of limitations to ensure that it is in good standing and to move forward with litigating the matter. Our legal team at AutoAccident.com is prepared to protect the rights of our clients in front of a jury or judge if settlement negotiations do not provide the resolution that is deserved.

There is a strict procedure that must be followed when it comes to filing a wrongful death case and working toward a successful resolution. This includes a collection of evidence before it is lost or destroyed, conducting an independent investigation, working with expert witnesses to establish negligence and damages, and more. Please speak with a knowledgeable California wrongful death lawyer from our law firm to discuss the information on how to proceed in your situation.
