Things to Know About Motorcycle Accident Cases

Car versus motorcycle crashes happens all too often on roads in Fremont and throughout California. Motorcyclists do not have the same level of physical protection that motor vehicles offer. Therefore, a collision with a car may result in catastrophic injuries or even death to a biker. When this occurs, an injured biker or a family of a deceased motorcyclist may have grounds for a personal injury claim or a wrongful death action against the other side for the damages incurred.

Do not speak with the insurer until you have first discussed your case with a skilled California wrongful death lawyer. The matter may be compromised if you provide information to the insurance company without legal counsel. Insurance carriers may use recorded statements in an attempt to devalue or deny your wrongful death claim. Therefore, reach out to an experienced and compassionate lawyer immediately to protect your rights and best interests.

How Much Time Do You Have to File for Wrongful Death?

California has a filing deadline known as the statute of limitations. Per CCP 335.1, surviving family members have up to two years from the date of a fatal incident to file a lawsuit for wrongful death against at-fault parties. Waiting too long to file may result in the loss of the right to seek financial recovery. To protect your rights, contact an experienced injury lawyer near you.

Personal Injury Attorney in Fremont

I’m Ed Smith, a Fremont personal injury attorney. Riding a motorcycle may be fun and exhilarating, but it may come with many risks. There is little to protect motorcyclists if they are involved in a crash with a motor vehicle. This may lead to traumatic injuries or even death for those involved. If the incident was the result of driver negligence, a personal injury or wrongful death claim may be in order.
