What Qualifies as a Wrongful Death Motorcycle Accident Case?

Surviving family members may be hesitant to take legal action in the form of a wrongful death action against the at-fault party and their insurance company. However, it is in a family’s best interest to do so. A wrongful death claim may provide survivors a sense of justice for their loss and financial compensation for resulting damages. This may assist with loss of income, funeral costs, lost future earnings, and other financial losses. It may also compensate surviving family members for the intangible harm they have experienced, such as mental anguish and loss of protection, guidance, care, and affection.

When bringing a claim for wrongful death from a car vs. motorcycle accident, the burden of proof is on survivors. This means that surviving family members are required to put forth clear and compelling evidence demonstrating that the loss of life occurred from the other side’s negligence and not from another cause. However, this is not always a straightforward thing to do. Working with an experienced and compassionate Hayward wrongful death lawyer can help a grieving family overcome this challenge and others in the legal process.

A wrongful death claim may be filed by the decedent’s spouse, domestic partner, or children. These relatives have priority in these cases per CCP 377.60. Other relatives who were financially dependent on the deceased may also have grounds for filing if the decedent does not have a spouse, domestic partner, or children. Civil cases have deadlines that are known as the statute of limitations. This establishes a time limit a claim must be filed within, or the court will not hear the case. Most wrongful death actions are subject to a two-year statute of limitations. This is why it is crucial to discuss the specifics of a claim with an experienced injury attorney, such as ours, from our law firm. Learn how we can help by watching the video below.
