What Surviving Family Members Should Know About Wrongful Death Cases

As a motorcyclist, you cannot protect yourself from harm’s way on the road, no matter what precautions you take. Drivers are not always responsible, and someone else’s negligence may cause serious harm to motorcycle riders and others on the road. When a fatal motorcycle accident occurs because of a negligent driver, surviving family members may have grounds to file a wrongful death claim against that party and their insurance company to seek reimbursement for their losses. These may be in the form of economic and non-economic damages. Loss of future financial support, funeral service costs, loss of companionship, mental anguish, and expenses for end-of-life treatment are just some of the many losses that may be sought in this type of case.

Just like other types of accident cases, motorcycle crash claims are dependent on liability. For survivors to bring a successful case forward, they must have clear and compelling evidence that demonstrates negligence on the part of the other side. It must also be shown that the other party’s negligent actions were the direct cause of the crash, injuries, and resulting damages. These cases are also subject to a two-year statute of limitations. This is a time frame that sets a deadline on when a lawsuit must be filed in civil court. Failure to file a lawsuit in court within the applicable time frame may lead to its dismissal per the court’s discretion. Keep in mind that the deadline may be shortened in cases where a public agency is named as a defendant. Therefore, it is crucial to retain legal counsel immediately to ensure that you comply with all filing criteria and deadlines.

Families cannot depend on the insurance company to make things right with them after the loss of a loved one. Insurers often attempt to take advantage of survivors by approaching them and making quick settlement offers. However, such offers will be far less than what a family needs to make them whole again after a fatal motorcycle accident. Surviving family members should not have to face the insurance carriers alone in such a difficult time. The first step in protecting your rights as a surviving family member is to consult an experienced motorcycle accident attorney in Stockton.
