What You Should Know About Motorcycle Accident Cases

When a motorcycle accident is the result of another driver or entity’s negligence, a motorcyclist may be entitled to financial compensation through a personal injury claim. How much an injured biker receives in financial recovery may depend on several factors. This may include the amount of bodily injury liability coverage the at-fault party has and the amount of uninsured and underinsured motorist coverage (UM and UIM) the injured motorcyclist has to supplement or fully cover damages incurred. Conversely, the severity of the injuries suffered in the traffic collision and time missed from work may also be considered in the claim.

When a motorcyclist suffers serious injuries in a crash with a passenger car or another type of vehicle, it may impact all aspects of their life. This may include the ability to engage in hobbies, spend time with friends and family, and taking care of yourself. Damages for pain and suffering may consider the emotional anguish and the physical pain the biker has suffered, as part of the personal injury case. Keep in mind that the claims process is not always straightforward as there may be challenges with the insurance company.

Having an experienced injury lawyer on your side may make a difference in the outcome of your claim. An accident attorney may help in navigating the case, advising you what to expect from your claim, and protecting your best interests from difficult insurers. A lawyer will also collect and preserve evidence necessary in proving the case and conducting an independent investigation of the incident to properly determine fault. Ideally, you should retain legal counsel right away as the insurance carrier may act quickly to shift blame onto you for the crash.
