Modesto Woman Fatally Shot by Police

I’m Ed Smith, a Modesto Personal Injury Attorney. In the early hours of Saturday October 8, 2016 police were dispatched to a Modesto home twice within a one-hour time frame. What began as a domestic dispute ended with a woman being shot by law enforcement.

The First Call to Police

Officers were first dispatched to a residence on the 1500 block of Queens Avenue in Modesto on Saturday morning. The caller was reporting that his 53-year-old daughter was under the influence and vandalizing the inside of his home. Officers arrived at the home only to learn the woman had recently left.

The Second Call to Police

About an hour after the original call was made to Modesto Police, a second call was received from the same Queens Avenue residence. The caller stated that his daughter had returned to the home and had brought a knife with her.

What Happened?

When police arrived on scene the second time, the armed woman met the officers on the street. The officers told the woman to drop the knives. Officers said she failed to follow their commands. Next thing they knew, she was charging at them with the knives raised above her head. Officers utilized beanbags and a Taser before one of the officers fired his duty weapon. It is not known at this time how many shots the officer fired.

Woman Passed Away as a Result of Gunshot Wound

The woman had to be transported to a local hospital. She passed away as a result of sustaining a gunshot wound. Her identity has not been released.

The three officers who responded to this call were uninjured and have been placed on paid administrative leave, which is a standard procedure with all officer-involved shootings.

 Multiple Investigations Underway

A Modesto Police spokesperson said in a statement that investigators are processing the crime scene and collecting witness statements. The Stanislaus County District Attorney’s Office is conducting an independent review of the situation. Modesto Police Department is doing both an administrative and criminal investigation. This is the fourth officer-involved fatal shooting in Stanislaus County. This is the second this year involving a Modesto Police Department officer.
