Modesto Motorcyclist Killed in Sunol Truck Crash

A motorcyclist from Modesto was killed in a fatal crash with a construction truck in Sunol on the morning of Tuesday, October 27, 2020. The deadly motorcycle accident occurred on Interstate 680 near Sunol around 6:30 a.m. A man was riding his Suzuki motorcycle northbound on I-680 in the vicinity of Andrade Road, according to the California Highway Patrol (CHP). For unknown reasons, the biker was involved in a collision with an unoccupied Chevrolet pickup truck owned by a construction company and parked in a marked lane closure. The motorcyclist was propelled off his bike and landed in the No. 3 of Interstate 680, where he suffered fatal injuries. The Alameda County Coroner’s Office has identified the decedent as 20-year-old Alexis Ponce Garibay of Modesto.

Who is at Fault for a Fatal Motorcycle Accident?

One of the many misconceptions about motorcycle accidents in construction zones is that they are the result of rider error. However, that is not always the case. Construction zone crashes involving motorcyclists may often be the result of a biker trying to get out of the way of a road defect or another car. To avoid the initial collision, the biker may strike other objects in the roadway like medians, guardrails, trees, buildings, and parked vehicles. In other situations, the biker may come into contact with a hazardous condition in the road due to unsafe roadway design and maintenance. The resulting accident does not necessarily mean that the motorcycle rider was responsible for the incident and resulting damages. Leave it to an experienced motorcycle accident lawyer in Modesto to conduct an independent investigation of the incident to properly determine fault on the part of:

  • CalTrans
  • Third-Party Contractors
  • Repair Crews of Local Government Entities

What are the Common Causes of Motorcycle Accidents in Construction Zones?

Any road work zone can pose a hazard to motorcycle riders. Whether moving at slow or highway speeds, motorcycles are at a high risk of falling objects or gravel strikes. Following are some of the many dangers faced by motorcycle riders traveling through construction zones:

  • Loose debris and gravel can cause a biker to lose control of their motorcycle along a bottlenecked road in a work zone.
  • Malfunctioning or faulty road work zone signage is important to notify drivers of the dangers ahead, and failure to warn of construction zone hazards may increase the risk of a motorcycle wreck.
  • Negligent workers operating vehicles delivering equipment to the worksite
  • Poorly placed road barriers to protect traffic of opposite lanes drifting into oncoming vehicles

What is the Statute of Limitations for a Government Entity Claim?

A wrongful death claim against a government entity is subject to a statute of limitations in California. This means surviving family members have a strict amount of time to file a lawsuit. Under the California Government Code Section 911.2, survivors have six months or 180 days to bring a claim with the government agency responsible for the wrongful death of their loved one. If the family misses the deadline, the wrongful death motorcycle accident case may be dismissed at the discretion of the court, and the right to claim financial compensation may be lost.
