What You Should Know About Pedestrian Accident Injury Cases

A pedestrian accident may result in some of the most severe injuries on the spectrum. That is because those on foot do not have the same level of protection as those in motor vehicles have, like seatbelts and airbags. With no physical protection, a pedestrian is likely to suffer traumatic injuries such as bone fractures, head trauma, spinal cord injuries, internal trauma, and more. Any of these injuries may lead to a never-ending pile of medical expenses followed by time away from work for recovery. This situation may put an injured party and their family in a financial predicament. Fortunately, they may have the right to take legal action against the at-fault driver through a bodily injury claim. This type of case is generally brought against the insurance company representing the negligent motorist.

There may be some circumstances where uninsured and underinsured motorist coverage may be utilized in a pedestrian accident case. When a driver crashes into someone walking and does not have auto insurance, UM coverage may be utilized to pay for losses up to the limits of the plan. Conversely, if the at-fault party had insurance at the time of the incident but not enough bodily injury liability coverage to pay for the pedestrian’s losses, UIM coverage may apply. If the injured party did not have a car insurance policy of their own with UM and UIM protection but lived in a household with someone who does, a claim may be brought under that plan under specific circumstances. This includes not being listed as an excluded member.

The negotiations process with the insurance company may be stressful and overwhelming, to say the least. That is because insurers often make lowball settlements that are not enough to cover damages quickly. For reasons such as these, it is essential to retain legal counsel that can communicate effectively with insurance carriers on your behalf to ensure that you are fairly compensated for your injuries and losses. An accident attorney will know the best way to proceed with building a strong case, including working with experts in the field to prove and calculate the extent of damages incurred. When you have suffered serious injuries in a pedestrian accident caused by a negligent driver, it pays to work with a lawyer that has the experience, skills, and resources to handle your case.
