Modesto Couple Injured by Speeding Car

A couple from Modesto was recently injured after being hit by a car that was speeding in their neighborhood. The car accident occurred along Blue Gum Avenue in west Modesto. A man and his girlfriend were sitting inside their parked truck in front of their house when they were struck head-on by a speeding vehicle. The father of the injured man said the couple was lucky to be alive and only suffered minor injuries in the crash. Additional details regarding the incident were not immediately available.

Aftermath of a Motor Vehicle Accident

An auto accident is one of the most stressful and overwhelming experiences that can ever happen to you. You may find yourself attempting to claim recovery of your medical expenses, lost income, and pain and suffering. The insurance company representing the at-fault party will act quickly to convince you to settle your claim or say that the crash was partially or entirely your fault. Do not believe what they say nor agree to provide recorded statements or sign any medical authorization release forms. The decisions you make after a motor vehicle collision, like contacting the best Modesto car accident lawyer, will play a factor in the value of your personal injury claim.

Types of Recoverable Damages in a Personal Injury Case

Our Modesto car accident lawyers at AutoAccident.com will seek both economic and non-economic damages for our clients. Economic damages refer to financial losses such as past and future medical expenses, lost wages, loss of future earning potential, property damage, and other out of pocket expenses related to the car crash. Non-economic damages refer to intangible losses like diminished quality of life, loss of consortium, and pain and suffering. While other damages may be available to a personal injury claimant, the type of compensation available in the claim will depend upon the specific facts and circumstances of the case. For information on the factors that may affect the value of these cases, watch the video below.

Proving Fault in a Modesto Speeding Car Accident

To successfully recover damages in a personal injury claim, the claimant in the case must be able to prove that the other driver owed them a duty of care, the other driver breached or violated that duty of care, their negligence was the proximate cause of their injuries, and they suffered damages as a result.

Negligence in the context of a motor vehicle collision generally means unreasonably safe driving behaviors. Proving unsafe driving practices goes beyond providing a CHP traffic report. It includes requesting a copy of the other party’s driving record, photos of the car accident scene, eyewitness statements, video surveillance of the crash site, hiring accident reconstruction experts, and other forms of evidence. Where the actions of the at-fault party were particularly egregious, punitive damages may be awarded at the discretion of the jury, which is generally paid by the negligent driver directly.
