Deputy Crashes Patrol Car During Pursuit

I’m Ed Smith, a Modesto personal injury attorney. A deputy attempted to pull over the motorist of a white Mercedes during the afternoon hours on Sunday, December 25, 2016. During the chase, the deputy was involved in an automobile accident with another driver on the roadway.

What Happened?

A  Stanislaus County Sheriff’s deputy received a report that a man had wrapped a firearm that was suspected to be a long rifle and put it in his vehicle. The vehicle was identified as a white Mercedes which the deputy later spotted along Carpenter Road. The deputy attempted to pull over the driver of the Mercedes, but the driver would not stop which led the officer on a pursuit through the streets of Modesto.

Pursuit Causes Crash

The deputy followed the driver of the Mercedes from Carpenter Road turning southbound on to 8th Street. Where the driver of the Mercedes ran a stop sign at the intersection of 8th Street and K Street. The deputy was rear-ended by another driver in a Lexus that was traveling eastbound along K Street at approximately 2:15 pm. The deputy lost control of the patrol vehicle and collided with a sign and tree along the east side of 8th Street. Thankfully, the deputy sustained minor injuries and was transported to a nearby hospital for treatment.

Pursuit Driver Detained

The motorist of the Mercedes was able to get away for a short time due to the patrol car collision  According to Lieutenant Marc Nuno from the Stanislaus Sheriff’s Department, the deputy was able to obtain and report the license plate number of the Mercedes which later revealed the identity of the driver. The driver was identified as 34-year-old Rafael Alvarez. Alvarez was later found at a home located along the 200 block of Rosemont Avenue and was arrested. The reported firearm was not found in the vehicle and Alvarez was suspected of disposing of the firearm within the time frame he had before he was detained. Alvarez was later taken to jail and charged with reckless evasion of a police officer and a probation violation regarding his electronic ankle monitor.
