Claiming Wrongful Death After a Fatality Accident

When a motorcycle accident results in a fatality, our personal injury lawyers know how to obtain fair compensation for the grieving family. To help you get the maximum compensation, we investigate the fatal collision so that evidence is collected to support the family’s claim and calculate the damages you should be able to recover. In addition, negotiate with the insurance company on your behalf to obtain the most favorable outcome. In the event that the insurance company refuses to pay what you deserve, you can take your case to civil court, where the evidence in your claim can be used.

What Are the Requirements for Filing a Wrongful Death Claim?

If negligence caused the death of a loved one in a motorcycle crash, the immediate family of the deceased can file a wrongful death claim. It includes the spouse and children, regardless of whether they are biological or adopted. It is also possible for stepchildren who received at least half of their support from the decedent to file. There is a possibility that a deceased decedent’s offspring who had children may join the lawsuit if they have died but have children. The administrator of the estate may file instead, but only one claim may be made. The parents and siblings of the deceased may file a claim if there are no immediate family members.

Wrongful Death Damages That Can Be Recovered

A number of factors influence the amount of damages that can be recovered following a motorcycle fatality accident, including the decedent’s age. There are, however, a number of items that may be recoverable by the family:

  • Expenses related to the funeral and burial of the decedent
  • In addition to the deceased’s wages, the family can obtain any benefits they received during their working career
  • Loss of love, affection, and consortium can be recovered by the spouse
  • It is possible for children in the family to recover the lost nurturing and guidance
  • There is the possibility of claiming loss of household assistance
  • It is possible to recover inheritance loss in some cases
