Claims for Wrongful Death and Compensation Awarded to the Family
In California, the family of someone who died as a result of a negligent driver can file a claim for wrongful death. In the claim, they can recover the end-of-life expenses, wages until the loved one would have reached retirement, and compensation for their personal distress and loss.
In addition, drunk driving can be the basis for punitive damages awarded in a Mendocino County fatal crash wrongful death case. The law views drunk driving as an act of gross negligence or willful misconduct, meaning the at-fault party’s behavior goes beyond ordinary negligence. Punitive damages are intended to punish the wrongdoer and deter similar conduct in the future.
To successfully pursue punitive damages, the plaintiff must prove that the driver acted with malice, conscious disregard for safety, or intentional harm by choosing to drive while intoxicated. California courts take these cases seriously, underscoring the state’s firm stance against impaired driving.
