Man Rescued from Burning Vehicle in Knights Ferry

A man was rescued from a burning vehicle after a car accident near Knights Ferry in Stanislaus County, CA, on the afternoon of June 21, 2020. The motor vehicle collision occurred on Highway 108, where a truck reportedly veered off the roadway and crashed into an embankment. A 45-year-old Modesto man witnessed the accident and immediately pulled over to assist. The good Samaritan, along with a Stanislaus County sheriff’s deputy, freed the man from the truck, which was starting to smoke and catch fire. The crash victim was taken to the hospital for treatment of unspecified injuries. Fortunately, medical officials said he is expected to make a full recovery.

Who is Responsible for a Single Vehicle Accident?

Motor vehicle collisions, unfortunately, occur all too often in California, and single-vehicle accidents are no exception. While many assume that car accidents involving one car are caused by driver error, this is not always the case. There are some situations where other parties may be held financially accountable for the injury and damages caused in a crash. This includes government entities for roadways in poor conditions and automakers for manufacturing defects.

Motor Vehicle Accidents and Car Defects

Automakers are responsible for ensuring that vehicles operate as safely as possible in the event of a car accident. The measurement of how well a motor vehicle protects its occupants from the effects of an auto accident is known as crashworthiness. Automakers must meet standards set by the National Highway Traffic Safety Administration (NHTSA) to receive crashworthiness ratings for different types of motor vehicle collisions. This means cars are examined to see how well they handle impacts in rear-end collisions, broadside accidents, rollovers, and head-on collisions. If the manufacturing or design of a vehicle has failed to meet crashworthiness standards, the car manufacturer may be held liable through an auto products liability claim.

Auto Accidents and Roadways in Poor Conditions

Government agencies are responsible for the design and maintenance of public roads. However, not all roadways are maintained to safety standards, resulting in potential road defects. Common examples of faulty roadways include cracks, broken concrete, uneven road surfaces, potholes, and sinkholes. When a road surface is uneven, it may cause a driver to lose control of their car and result in a collision causing injury to the motorist, passengers, and others on the roadway. Large potholes have the potential to burst tires and cause vehicles to veer into other traffic lanes, leading to the increased risk of a crash.

Claims for damages against a government entity is more challenging than claims against other drivers. This is because a government entity claim follows a different statute of limitations. In California, there is a six-month statute of limitations on these types of cases. If a notice of claim is not brought within the deadline, the court may deny their case, and the right to recover compensation may be lost entirely. That is why it is crucial to work with an attorney after a dangerous road condition accident. For details on what to look for in a reputable injury lawyer to handle your case, watch the video below.

Is Hiring a Personal Injury Attorney Worth It for a Knights Ferry Burning Vehicle Accident?

The types of personal injury damages available to accident victims who suffer injuries as a result of a vehicular safety defect or hazardous road conditions vary. They may include economic and noneconomic losses, like medical expenses, lost wages, temporary or permanent disability, pain and suffering, and other damages caused by the crash. Each personal injury case is unique, and the amount of financial compensation that an injured person is entitled to receive will depend upon the facts and circumstances of the accident as well as the injuries involved. Proving damages in auto products liability cases are especially complicated since it must be demonstrated that the injury was enhanced due to the lack of vehicle crashworthiness or automotive safety defect. This is why it is essential to have an experienced Oakdale personal injury lawyer at your side to build a strong case on your behalf, negotiate with insurance companies, and present it in court if needed.
