What You Should Know About Wrongful Death Claims in California

The loss of a loved one is always a devastating and heartbreaking experience for a family. When the loss occurs suddenly, it may also leave surviving family members with financial hardship as funeral expenses and medical bills accumulate in addition to emotional suffering and mental anguish. If the fatal incident was the result of someone else’s negligence, there are actions that may be taken to ensure that the at-fault party has been held accountable for the harm their conduct has caused. This may be accomplished through a wrongful death claim filed with the other party’s insurer. While there is nothing that may make up for such a loss, a wrongful death claim may help a family in moving forward with the sense of justice and financial compensation they deserve.

The decedent’s surviving spouse, domestic partner, and children have priority when it comes to receiving wrongful death benefits. This is outlined in the California Code of Civil Procedure Section 377.60. If such parties are nonexistent, other relatives may also be eligible to claim compensatory damages. In a wrongful death case, economic and non-economic damages may be sought and serve the purpose of compensating the deceased person’s family for resulting losses. These may include expenses for funeral services, costs of medical treatment incurred before the decedent passed away, loss of future financial support for survivors, mental anguish, and more.

Wrongful death cases in California are subject to strict filing criteria and deadlines. An experienced accident attorney may help surviving family members navigate these requirements and obtain a favorable outcome in your claim. Retaining legal counsel not only provides you more time to be with your loved ones but also takes the burden of proving the case to difficult insurers and defense attorneys off your shoulders.
