Man Killed in Fatal DUI Crash in Madera County

A man was killed in a fatal crash on the early morning of Sunday, November 1, 2020, in Madera County by a driver suspected of DUI, the California Highway Patrol (CHP) reported. The fatal incident was reported at approximately 1:00 a.m. on Road 222 in the vicinity of Bonnie B Road in the North Fork area. A man was involved in an unrelated single-vehicle accident that caused his 2005 Porsche Cayenne to come to a rest on its roof in the roadway. A driver of a 2001 Chevrolet, identified as a 38-year-old North Fork man, was headed westbound on Road 222. The Chevrolet driver reportedly crashed into the Porsche driver and his overturned vehicle in the road.

CHP traffic units reported that the driver of the Chevrolet attempted to render life-saving measures to the Porsche driver. Upon the arrival of emergency personnel, the driver of the Porsche, 28-year-old Joshua Ghziouna of North Fork, was pronounced deceased at the scene. Officials reported that the Chevrolet driver was reportedly under the influence of alcohol and arrested him on felony manslaughter and felony DUI charges.

Loss of Close Relative to Wrongful Death

When a loved one is lost in a fatal motor vehicle accident, it is challenging to consider options on moving forward. Survivors often feel that they have no choice for what comes next when having a family to care for and be there for. If the loss resulted from someone else’s recklessness or negligence, a wrongful death claim is the first step to take in the right direction. An experienced Madera wrongful death lawyer can advise a family of their best course of action and protect their legal rights in their time of loss and grief.

Types of Recoverable Damages in a Wrongful Death Lawsuit

The purpose of a wrongful death case is to compensate survivors for their emotional and financial losses. In California, a lawsuit for a loved one’s wrongful death may seek recovery of the following:

  • Economic Damages: These consider the financial losses incurred by the wrongful death of a loved one. Examples include end of life medical treatment costs, funeral expenses, lost future financial support, loss of inheritance or benefits, and more.
  • Non-Economic Damages: These include losses resulting in emotional suffering and mental anguish for surviving family members. Losses related to the protection, companionship, care, and more fall under the category of non-economic damages.
  • Punitive Damages: A Madera wrongful death attorney may seek punitive damages from the at-fault party as a way of punishing them for their egregious conduct that resulted in the loss of a loved one.
