Loss of a Loved One After a Coffee Road Pedestrian Accident

Few things in life are as devastating as losing a close relative in a preventable pedestrian accident. When a loved one is suddenly taken away from a family without warning, the loss may be even more challenging to come to terms with. A family deserves time to process and grieve from their loss without having to deal with negligent drivers and their unsympathetic insurance companies. Hiring an experienced wrongful death lawyer from Modesto can give the family the time they need to do that. It may also help them recover the compensation and justice they deserve.

Damages in a Wrongful Death Case

When a pedestrian accident results in a loved one’s unexpected death, a family may file a wrongful death claim to obtain financial support, closure, and justice. Such cases may be filed when a loved one is killed in a crash when fatal injuries were unlikely if preventable measures had been taken. Following are damages that may be recovered through a wrongful death case:

  • Costs of medical care related to the pedestrian accident before a family member’s wrongful death (this may be claimed through a survival action)
  • Funeral and burial expenses
  • Loss of affection, companionship, protection, and guidance for the family
  • Lost future income, inheritance, and benefits for survivors
  • Mental anguish and emotional suffering as a result of a loved one’s wrongful death
  • The value of household services the family received by the decedent

Who Can File a Wrongful Death Claim in California?

Surviving spouses, domestic partners, and children are entitled to damages through a wrongful death claim, as stated in the California Code of Civil Procedure Section 377.60. If such relatives are nonexistent, others may be eligible to file for wrongful death. This may include parents, stepchildren, putative spouses, or children of the putative spouse. Any minor who lived with the decedent for 180 days and was financially dependent on them may also be able to file a claim.

Do You Need a Wrongful Death Attorney for a Pedestrian Accident?

After a wrongful death pedestrian accident, the negligent driver’s insurance company may say that a loved one was partially or entirely at fault for their fatal injuries. Even if there is strong evidence proving liability on the part of the motorist, a family may face a dispute with insurance claims adjusters regarding the value of their loved one’s life and wrongful death damages. This is why it is essential to work with a Modesto wrongful death lawyer. An attorney will ensure a family is treated fairly and obtain a fair recovery on their behalf.
