Loss of a Loved One

The loss of a loved one in a fatal pedestrian accident is devastating. You and your family should deserve justice if your loved one’s death was the result of another driver’s negligence. When this happens, you may be able to seek justice and compensation through a wrongful death case filed against the at-fault party and their insurance company. However, doing this on your own can be stressful and overwhelming, especially when coming to terms with your loss. This is where the assistance of an experienced Stockton wrongful death lawyer can prove invaluable. An attorney can deal with the challenging legal issues that often present in wrongful death claims and will compassionately assist you and your family in seeking a fair financial recovery.

Can a Family Member Sue for Wrongful Death?

A wrongful death lawsuit can be filed by a surviving spouse, domestic partner, or child against a negligent party or entity to collect financial compensation for the loss of a close relative. Some damages are common to all cases of wrongful death, while others are unique and based on the person’s relationship to the decedent. In California, a husband or wife who has lost a spouse may be compensated for the value of household services and lifetime income the decedent would have contributed to the family. The same damages may also be recovered in the case of a domestic partner. A child who has lost a parent can recover damages for the loss of future financial support the deceased parent would have given them if not for the wrongful death pedestrian accident. Funeral expenses, medical bills, mental anguish, and loss of a loved one’s care, companionship, and protection may also be claimed by surviving family members through these types of cases. How Long Do You Have to File a Wrongful Death Lawsuit?

The laws in California recognize the emotional and financial hardship that occurs with the loss of a close relative. Under the California Code of Civil Procedure Section 335.1, a family member has two years to file a claim for the wrongful death of a loved one and damages incurred. While financial compensation may never fill the void of losing someone you love, it can provide a means holding negligent parties accountable for their wrongdoing and securing a family’s future. Of great importance to this challenging time is that a family can depend on an experienced and compassionate wrongful death lawyer in Stockton to handle all aspects of their case to ensure they focus on what matters most in their lives.
