Can Insurance Cover a Ceres Hit and Run Accident?

After a hit and run accident, an injured person may wonder how their damages will be covered. This is especially true if the suspect driver is not located. In situations like these, an injured party may be able to use their own car insurance if they have uninsured/underinsured motorist protection (UM/UIM). This is a type of auto insurance that covers an injured person for the emotional, physical, and financial damages they have suffered when the negligent driver has little to no insurance to cover such losses. Conversely, a hit and run is a situation where there may be no details on the suspect party, which may be the same as attempting to recover from an uninsured driver. In this case, uninsured motorist protection may apply. If an injured pedestrian does not have car insurance but lives with someone who does, UM/UIM protection may be extended to them so long as they were not excluded from the policy.

How Do Personal Injury Cases Work?

A personal injury claim is intended to compensate an injured person for the economic and noneconomic damages they have suffered. Economic damages refer to the financial and quantifiable losses an injured person has incurred, while noneconomic damages consider the intangible harms that have been endured due to the physical injury. These include:

  • Costs of past and future medical treatment
  • Loss of consortium, for the damage a personal injury has caused to a marital relationship
  • Loss of earning capacity, if a personal injury has caused a limitation on a person’s ability to earn wages
  • Lost wages, including past and future loss of earnings
  • Pain and suffering
  • Permanent disability
  • Property damage, for the costs of repairs or replacement of personal property damaged in a pedestrian accident, e.g., glasses or clothing

How Can an Injury Lawyer Help Me?

Since a hit and run may cause significant losses and various issues, an injured person should seek the assistance of an experienced Ceres personal injury attorney. An attorney who is experienced in handling pedestrian accidents, including those caused by a hit and run driver, knows the defense tactics and strategies negligent drivers and their insurance companies may use to avoid liability. Such tactics are often used to devalue a personal injury case or deny it altogether. In cases where the hit and run driver is not identified by officials, an attorney may hire their own team of investigators to track down the suspect motorist to hold them financially accountable for damages incurred. This is why it is essential to work with an experienced injury lawyer who knows how to overcome such complexities in a pedestrian accident case to ensure the injured person receives the fair compensation they need and deserve.
