Man in Wheelchair Hurt After Hit by Van in Modesto

A man in a wheelchair was seriously hurt after being hit by a van in Modesto on the morning of Thursday, September 24, 2020. The pedestrian accident happened shortly after 8:00 a.m. along the 200 block of West Orangeburg Avenue near Doctors Medical Center. The Modesto Police Department (Modesto PD) reported that a 67-year-old man riding in a power wheelchair and a van were both headed eastbound on Orangeburg Avenue.

The van reportedly crashed into the man in the power wheelchair, causing him to bleed profusely from the legs due to the collision. First responders were called to the scene, and the Modesto PD stated that tourniquets were applied to both of the man’s legs to contain the bleeding. He was transported to Doctors Medical Center for immediate treatment. The driver of the van was uninjured in the incident and stayed at the scene to cooperate with the investigation, officials said.

Consequences of a Pedestrian Accident

When a vehicle strikes a pedestrian, catastrophic injuries are likely to result. Pedestrians have no form of physical protection in the event of a motor vehicle collision, so they may be propelled by the impact and suffer lacerations, bone fractures, back injuries, head trauma, and other types of serious injuries. Such trauma may result in mounting medical expenses, lost wages, pain and suffering, and other personal injury damages.

Injured pedestrians do not deserve to bear these costs caused by the negligence of another party or entity. An experienced Modesto auto accident lawyer can advocate on a pedestrian’s behalf, negotiate effectively with difficult insurance companies, and recover full and fair compensation on their behalf. If you are unsure of what to look for in a reputable attorney to handle your pedestrian accident injury case, watch the video below.

What if the Other Driver Does Not Have Insurance?

There are some instances where a pedestrian accident may be caused by a driver who carries little to no bodily injury liability coverage. Recovering personal injury compensation from an uninsured or underinsured driver may be challenging. Fortunately, uninsured/underinsured motorist coverage (UM/UIM) may be available in such situations. In a pedestrian accident caused by a driver with no insurance, UM coverage may be used to pay for injuries and damages incurred. When the injuries suffered in a pedestrian accident are catastrophic, and the losses are high, UIM coverage may be used to help supplement any losses not fully paid for by the at-fault party’s insurance company. What some people may not know about UM/UIM coverage is that it can extend to other members of a household and provide protection to them if they were injured in crashes as cyclists or pedestrians. This is possible so long as they were not excluded from the insurance plan.

Even if you have adequate bodily injury liability coverage, including UM/UIM, filing a personal injury claim with your insurance company may be challenging without a Modesto auto accident attorney. Insurance carriers will resort to defense tactics to keep you from recovering the personal injury compensation you rightfully deserve. After all, paying the full and fair value of your damages can affect their bottom line. Do not let this happen to you and seek legal assistance right away.
