Drunk Driver Was Speeding at the Time of the Fatal Accident

A preliminary investigation into the crash by police indicated that the DUI driver was going above the speed limit along eastbound Hartnell Avenue near Churn Creek when he crashed into the other Silverado, which was exiting a driveway. Drunk Driving and Auto Accidents

A family who loses a loved one in an accident caused by a negligent driver may want to file a wrongful death claim to recover damages. Although it will not ease their grief, it can help them avoid the financial distress that often accompanies death, especially if the person who died contributed to the family’s income. Recoverable damages include:

  • The expenses for the funeral and burial
  • Recovery of the wages, bonuses, pension and insurance the decedent would have earned until their retirement age
  • The spouse can recover compensation for their loss of consortium, moral support and affection
  • The family’s children can recover damages for the loss of nurturing and guidance
  • Compensation for the loss of household services, including lawn and auto care, childcare and other tasks
