Things to Know About Accident Cases

When an individual has suffered injuries in a motor vehicle collision in California, they may be entitled to financial compensation for their losses through a personal injury claim. This is generally filed against the driver responsible for the collision and their insurance company. To bring a successful claim forward, negligence on the part of the other side must be proven through clear and compelling evidence. Some of the common reasons for traffic collisions involving negligence may include but are not limited to driving under the influence of alcohol or drugs, texting while driving, fatigued driving, speeding, reckless driving, and other violation of the rules of the road. Once this has been accomplished, an injured party may seek recovery of economic and non-economic damages such as wage loss for time missed at work, expenses for past and future treatment, pain and suffering from accident-related injuries, and more.

Remember that there is a limited amount of time to take legal action in California. That is because claims are subject to strict deadlines known as the statute of limitations. These are typically two years but may be shortened to six months in those cases involving public entities. While this may seem like sufficient time to bring a case forward, the unfortunate reality is that there is much more involved in building an injury case. That is why it is recommended to retain legal counsel after getting injured in a recent motor vehicle collision. The sooner that an attorney is hired, the more time the lawyer will have to build a compelling case for fair compensation.
