Accident at Howe Avenue Intersection Involves Motorcyclist and Passenger Car

A major injury was reported in Sacramento on August 26 after a motorcycle and car collided at an intersection. The accident was reported by the California Highway Patrol (CHP) around 11:42 a.m. and occurred at the intersection of Howe and Marconi avenues between a Lexus sedan and motorcycle rider. The motorcycle ended up blocking the number one lane.

Motorcyclist Transported to Hospital With Major Injury

Upon the arrival of emergency responders with the Sacramento Fire Department, the injured party was removed to the parking lot of Circle 7 to assess injuries. When it was determined the motorcycle rider had suffered a major injury, the patient was transported to a nearby hospital for additional evaluation. CHP is investigating to find out the cause of the accident will determine who was at fault.

Passenger Vehicle Drivers Are Often Negligent Around Motorcyclists

Motorcycle accidents can cause some of the most devastating injuries in a traffic collision due to their lack of protection. However, one of the problems that lead to these accidents is negligent motorists, who are attuned to watching for other drivers but not for motorcycle riders, bicyclists or pedestrians. When a motorcycle rider has suffered an injury caused by one of these negligent drivers, having a lawyer by your side who handles this type of claim is important.

Unfounded Bias Against Motorcyclists

Let’s face it. Motorcyclists often take a bad rap, both by other drivers and by insurance companies. Bad publicity from movies and general perception by the public that motorcyclists speed and drive unsafely exists. Knowing how to counter those misperceptions is important to deal with the at-fault party’s insurance company or present a case in court.

A Good Investigation Is Important in Presenting a Motorcycle Major Injury Claim

Our investigators are experienced in gathering the evidence needed to support a major injury claim for damages by a motorcycle rider. By presenting compelling evidence, the injured client can recover the cost of all their medical expenses, wages lost from being unable to work and for their pain and suffering, both physical and emotional. Some of the areas from which evidence is gathered include:

  • The investigators go over the report filed by the police to ensure that it doesn’t contain any errors. This is because mistakes could make it difficult to file a claim for compensation.
  • The motorcycle itself is examined to look for defective parts such as the brakes or tires that could have caused the major injury accident. If a defect is found, the injured rider can place a claim against the manufacturer and others in the production line to recover compensation.
  • Accident reconstruction is performed, which is widely accepted by insurance companies and as evidence in civil court. It cannot only show the initial positioning of the vehicles but how the major injury accident occurred and often who was at fault.
  • Any witnesses to the major injury accident are interviewed. In some cases, a witness may capture the accident as it happened on their cell phone.
  • A search in the area is made for surveillance cameras at the traffic intersection and nearby businesses.
  • The traffic record of the other driver is checked to see if they have a history of infractions or are driving on a suspended or revoked license.
