Reasons a Driver Might Not Be at Fault for a Rear-End Collision
Generally, a driver who runs into the rear of another vehicle is at fault. However, if one of the following occurred, those circumstances can change:
- The leading vehicle made a sudden stop: If the driver in front makes an abrupt stop without any justifiable reason, it can leave the trailing driver with little to no time to react.
- The leading vehicle reversed into the trailing vehicle: Although rare, a rear-end collision can occur when the leading vehicle unexpectedly reverses.
- The leading vehicle’s brake lights were not functioning: Functional brake lights are essential for communicating with other drivers. If the leading vehicle’s brake lights were not working, the trailing driver would not have enough warning to slow down in time, making the leading driver potentially responsible.
- A third vehicle or external factor caused the crash: Accidents sometimes involve more than two cars or external causes such as debris on the road or sudden weather conditions. If another driver’s actions or an uncontrollable external factor led to the crash, the driver in the rear may not be at fault.
- The leading vehicle made an unsafe lane change: If the leading driver cuts off the other vehicle by merging into their lane without leaving adequate space, it can create an unavoidable collision scenario. This behavior could shift the liability to the leading driver.
