Logging Truck Accident Near Placerville Results in Injuries

Injury Reported in Logging Truck Accident on Winding Way

An overturned logging truck accident caused injuries in a rollover that occurred on November 1 at Grizzly Flats southeast of Placerville. The collision occurred on Winding Way at Capps Crossing around 12:24 p.m. The California Highway Patrol (CHP) reported that Cal Fire emergency responders were called to the scene.

Injured Party Transported to Hospital in Private Vehicle

At least one person was injured in the collision and was transported to a hospital by a private driver instead of by Cal Fire medics. The owner of the logging truck arranged a private tow to remove the vehicle. The CHP is investigating to find out how the accident happened.

Causes of a Logging Truck Accident

The most common cause of truck accidents is driver error. This can include speeding, distracted driving or other driver errors. Some of the additional causes of an accident involving a big truck other than driver error include:

  • Poorly maintained trucks: When a large vehicle frequently takes winding, hilly routes, which is common with a logging truck, they need to be in good repair. Anything from a blown tire to brake failure can end up causing a collision, including a rollover.
  • Poorly maintained roads: When the government entity in charge of road maintenance fails in its duties, it can lead to a logging truck accident. The government entity, in these cases, may be held financially liable for any injuries. However, because the deadline to file against a government entity is six months, having such a short time means the injured party might benefit from the assistance of an accident lawyer.
  • Careless pedestrians or other drivers: When a pedestrian suddenly steps out into the roadway or another motorist is negligent, it can lead to an accident. When the rules of the road are broken and injuries occur, the negligent party may be held responsible.
  • Negligent loading of the truck or imbalance: When a flatbed or trailer is loaded by a third party and becomes unbalanced, a big rig can experience a rollover.

Determining Negligence in an Accident

There are many ways a logging truck accident can occur, and they are not always the fault of the driver. If a driver or another motorist is injured, an accident attorney can determine the cause. If negligence by another party or entity is the reason, they may be held responsible. In addition, if it turns out that a government entity, maintenance issues or negligence of another type resulted in the crash, the injured driver or others may place a claim to recover compensation to cover the cost of their injury and other losses.

A claim for compensation must be based on negligence when you’re injured in an accident. To determine the cause of your accident injuries, your injury lawyer will investigate the crash. As well as gathering all your medical bills, lost wages and damages for pain and suffering, your lawyer helps you recover compensation.
