Compensation in a Wrongful Death or Personal Injury Accident

When authorities prove that a driver was negligent and caused a Lodi traffic crash, those who lost a family member or suffered an injury have the right to recover compensation. A personal injury lawyer can help by gathering the evidence that supports the claim and negotiating with the at-fault driver’s insurance company to help recover maximum compensation. Because an injury lawyer works on a contingency basis, you can enlist their help to recover damages with no fee unless your case is resolved successfully.

Compensation in a Personal Injury Claim

When a negligent driver causes an injury collision in a Lodi traffic crash, compensation includes:

  • Medical: Those injured can recover costs for all medical expenses, including ambulance services, hospital stays, surgeries, doctor visits, medications, and rehabilitative care. If the injury persists at the time of settlement, a lawyer will estimate future costs and include them in the compensation.
  • Wages: Injured parties who lose wages because they cannot work can recover lost earnings. Those who take lower-paying jobs due to their inability to perform previous work tasks can recover the wage difference. In cases of permanent disability, victims can recover future wages up until retirement age.
  • Pain and suffering: Injury lawyers assist victims in recovering compensation for physical and emotional suffering.

Compensation in a Wrongful Death Claim

The spouse and children of the deceased may recover the following by filing a wrongful death claim following a Lodi traffic crash:

  • The family can recover a deceased person’s wages and other benefits up until their planned retirement age.
  • The family can recover funeral costs and other end-of-life expenses.
  • The spouse can receive compensation for the loss of love, moral support, and companionship the decedent provided.
  • The decedent’s children who received support can also receive compensation.
  • In some cases, recovering losses to inheritance is possible.
  • Recovering the cost of household assistance is also feasible. This includes chores the decedent typically did, like tax preparation, yard and auto maintenance, cleaning, cooking, and more. Since someone else will now have to perform these tasks, the costs are recoverable.
