Jogger Hospitalized After Merced Crash
Details on the Crash in Merced That Left a Jogger Hospitalized
A 42-year-old woman was jogging in the area of Narvaez Way and Whitewater Way close to Yosemite Avenue and McKee Road when she was hit by a Dodge Ram pickup truck. The driver of the Dodge, a 29-year-old man from Merced, remained at the scene and was said to have been cooperative in the investigation.
Merced PD officers at the scene located the injured party and reported that she sustained a major laceration to the head and experienced numbness in an area of her body. She was transported via air ambulance to a trauma center in Modesto for treatment of injuries described as major but non-life-threatening. An update on the car vs. pedestrian accident was not immediately available.
What You Should Know About Injury Cases and Pedestrian Accidents
Personal injury claims for car vs. pedestrian accidents are often challenging to navigate, particularly if the other side is disputing liability for the crash. One of the most difficult factors is the right-of-way in these cases. It is not uncommon for the insurance company representing the negligent driver to claim that the pedestrian was wearing dark-colored clothing, distracted by their cell phone, or not following the rules of the road at the time of the collision. These are just some of the many defense tactics insurers may use to get out of paying a claim. Even when these are involved, that does not necessarily mean that an injured party cannot seek compensation for their damages.
The preparation of a personal injury claim for a pedestrian accident generally requires clear and compelling evidence that demonstrates negligence on the part of the motor vehicle driver. In most cases, these include police reports, medical records, and the injured party’s recollection of the incident. However, other forms of evidence may also prove useful, such as video surveillance of the crash scene, photographs of the collision site, cell phone records of the driver’s activity at the time of the incident, images of the physical injuries from the impact, driving records, and more. Together, this evidence may be used by an experienced Merced pedestrian accident lawyer to establish liability on the part of the negligent driver. It may also be utilized to prevent the other side from unfairly shifting fault onto the injured party.
