Investigating Stockton Pedestrian Accidents

I’m Ed Smith, a Stockton pedestrian accident lawyer. Recently a 58-year-old female lost her life when she was hit by an SUV as she crossed the street behind the Sherwood Mall.

The pedestrian accident occurred in the vicinity of Tamworth Way and West Robinhood Drive. The location is a residential neighborhood located right behind a Home Goods store near the mall. Sadly, the victim died at the scene, according to Stockton Police Department.

An initial investigation reported that a 57-year-old female motorist was headed south on Tamworth Way near West Robinhood Drive in her 2000 Ford Expedition. The Expedition then struck the 58-year-old victim. The driver of the Expedition stopped and cooperated with police. She was not arrested.

Was the Pedestrian Using a Crosswalk?

No. Some people mistakenly assume that a motorist is without blame if the pedestrian was not in a crosswalk. In actuality, the totality of the circumstances in every pedestrian injury case must be considered. A single factor—like being in or out of a crosswalk—doesn’t mean a pedestrian cannot recover compensation for their injuries or losses.

One Sided Investigations

Sometimes when a pedestrian is struck and killed by a motorist there is only one side of the story being told. If the victim dies at the scene then his or her statement cannot be obtained by local authorities. Sometimes there are no independent witness available to give a statement. This can leave the victim’s family with many unanswered questions. That is why it is crucial to contact an experienced pedestrian accident lawyer if you or someone you love has been seriously injured or killed in a pedestrian accident.
