Injury Accident on Central Avenue in Fresno

At least one party suffered a minor injury after a car accident on Central Avenue in Fresno, CA, on the morning of April 15, 2020. The auto accident occurred around 11:30 a.m. in the area of South Chestnut Avenue and East Central Avenue. Two vehicles were involved in the crash, according to the California Highway Patrol (CHP). A tow truck was called to the scene to remove a disabled vehicle. Further details, including the cause of the accident and the conditions of those injured, were not immediately available.

How is Liability Determined After a Fresno Injury Accident?

When car crashes happen, determining who is at fault can be challenging. Even when liability seems clear, a thorough investigation of the facts and evidence of the incident is necessary for identifying liable parties. Such evidence can include police reports, witness statements, video surveillance of the crash site, and photographs of the scene and property damage.

What Can You Claim in a Personal Injury Case?

Once liability has been established, a person who was injured in a car accident may be able to recover both economic and noneconomic damages. This can be done by filing a personal injury claim with the other driver’s insurance company. The amount of fair compensation will depend upon the financial and intangible losses that result from the incident and how it has impacted the injured person’s life. Economic damages may include medical expenses, lost wages, loss of future earnings, and household services. Noneconomic damages may include mental anguish, loss of consortium, and pain and suffering.

How Soon Should You File a Personal Injury Claim?

Under the California Code of Civil Procedure Section 335.1, the statute of limitations for an auto accident case is generally two years from the date of the incident. If a lawsuit is not filed by this deadline, the court may dismiss the case, and the injured party may lose the right to claim financial recovery.

What Happens When the Other Driver Doesn’t Have Insurance?

Auto accidents happen every day. When they occur as a result of someone else’s negligence, you deserve to be compensated for your injuries and damages. Hopefully, the driver who caused the crash has car insurance to cover losses incurred. In cases where the at-fault party does not have enough insurance or none at all, your uninsured/underinsured motorist coverage (UM/UIM) is there to protect you and your passengers. Under most car insurance policies, there is the option of adding UM/UIM to your policy. This coverage generally matches the amount of bodily injury liability coverage you carry. Do You Need a Fresno Lawyer for an Accident Injury?

You may feel like you are in good hands if your insurance company is handling your personal injury claim. After all, you pay premiums for the coverage you have. However, when a UM/UIM claim is filed, your insurer does not always have your best interests at heart. Your insurance company is now financially liable in compensating you for your personal injury damages. They may use any defense tactic they can to reduce their financial liability. An experienced Fresno personal injury lawyer can investigate the facts and circumstances of your claim and determine an appropriate value for your case. Even more important, your injury attorney can collect evidence, locate witnesses, handle communications with insurance companies, and ensure all criteria and deadlines are met for your case.
