Injuries Reported in Turlock Pedestrian Accident

The Turlock Police Department (Turlock PD) reported serious injuries following a recent pedestrian accident. The incident occurred shortly before 11:00 p.m. at the intersection of East Glenwood Avenue and Lander Avenue.

Details on the Pedestrian Accident Resulting in Injuries Reported in Turlock

A 41-year-old man was walking in the area when he was struck by a van whose driver reportedly fled the scene. A press release by Turlock PD revealed that a witness followed the van driver for approximately two miles at the intersection of Greenway Avenue and South Walnut Road. The driver allegedly exited the vehicle and ran on foot into an orchard in the area. Officials with the Stanislaus County Sheriff’s Office attempted to locate the driver, but their efforts were initially unsuccessful.

Several hours later, Turlock PD reported that the van driver, a juvenile, arrived at the department with a parent to cooperate with the investigation. A recent release by officials revealed that the driver was later arrested on a hit and run charge on October 12. The following day, a family member identified as a 36-year-old Turlock man was detained on an accessory charge for allegedly urging the juvenile to flee the scene of the incident. Authorities indicated that the pedestrian sustained a traumatic brain injury as a result of the crash and it is not yet known whether they will make a full recovery from their injuries.

Is There Recourse in Hit-and-Run Accident Cases?

Any party involved in a motor vehicle accident may suffer traumatic injuries and losses of varying degrees. The challenges that may arise after the incident may be burdensome and overwhelming for an injured party who is attempting to get their life back on track but is dealing with mounting medical bills and time lost from work. The matter may be even more difficult to cope with when it was the result of a hit-and-run driver. California law requires an operator of a motor vehicle who was involved in a traffic collision to remain at the scene, identify themselves through information exchange, and render assistance to those injured as needed. Drivers who fail to do so may be subject to various penalties.

In some circumstances, the driver responsible for the hit-and-run accident may go unidentified, despite the efforts of local law enforcement. This may put an injured party at a loss, particularly when considering taking legal action to seek financial compensation for their losses. Fortunately, there may be recourse in this situation as an injured party may seek a financial recovery from their own insurer. Some policyholders may carry uninsured/underinsured motorist coverage (UM/UIM), and the UM portion of the plan may be utilized to cover damages resulting from a hit-and-run accident involving an unidentified driver. UM coverage will generally pay for losses up to the limits of the policy.

In cases where the injured party was a pedestrian or cyclist, UM coverage may also extend under such circumstances. If the injured party did not have an auto insurance policy at the time of the incident but lived with a relative who carried UM coverage, a claim may be brought under that policy so long as they were not excluded from it. Keep in mind that despite the matter being handled by your own insurer, that does not necessarily mean they will be fair when it comes to compensating you for your injuries and damages incurred. Given such concerns, it is essential to involve an experienced injury lawyer to advocate on your behalf and navigate the challenges that may arise in your claim.
